A court has acquitted a woman accused of attempted murder against former Machakos County Senator Boniface Kabaka.

The prosecution has stated that it does not have enough evidence to continue detaining the suspect after reviewing the report of an investigation to determine the cause of death of the deceased senator.

Esther Nthenya Muli, a high school teacher, was overheard as she was with Kabaka in a hotel the night she fainted before being rushed to the hospital.

Following the incident, Nthenya was arrested on December 7 last year on suspicion of involvement in an assassination attempt.

Kabaka died on the 11th of that month at Nairobi Private Hospital while receiving treatment.

Nthenya was later released but was ordered to report to the Kilimani Police Station every 14 days.

An investigative report in connection with Kabaka’s death revealed that there was no poison in his stomach, contrary to what was previously claimed.

Earlier on Thursday, Resident Magistrate in the Mount Court Daniel Ndungi ordered the release of the suspect.

The decision follows a request from the Director of Public Prosecutions for the dismissal of charges against Nthenya due to lack of evidence.
