The Judiciary has been plunged into chaos after a judge temporarily suspended Deputy Chief Justice Philomena Mwilu from office.

Meru High Court Judge Patrick Otieno ordered Judge Mwilu to step down and await a decision on the case filed by Judge Isaiah Mbiti.

In his application filed through counsel MD Maranya, Mbiti objected to Mwilu’s eligibility to continue serving when he faces a disciplinary hearing before the judicial recruitment commission.

Judge Mwilu has served as acting chief justice since last month following the retirement of Judge David Maraga.

Judge Otieno’s decision cripples proceedings in the high court, with cases pending now due to a lack of sufficient judges.

However the decision will not affect the activities of the commission of recruitment staff of the judiciary department which requires commissioners I am not alone in conducting its business. The commission will now have nine members if Judge Mwilu resigns.
