Lee Kinyanjui Loses Case Where His Car Ran Over Pedestrian

  • Nakuru Governor Lee Kinyanjui has been ordered by the High Court to pay a pedestrian Ksh1 million as compensation for serious injuries in a road accident.

    Reports indicate that a car owned by the governor hit Charles Mugi along the Nakuru-Nairobi highway on December 7, 2010.

    As a result, Mugi continued to have a permanent fracture in his right leg and accused Kinyanjui of damages and compensation to cover medical expenses.

    Judge Hilary Chemitei ruled that the Ksh1 million award was appropriate due to the tragedy.

    “Considering all the factors as well as the level of inflation, I think the Ksh1 million award would be appropriate in that context.

    “This should achieve at least part of future treatment,” Judge Chemitei said.

    The original court decision had given the victim Ksh1.5 million for total damages and another Ksh28,250 as special damages in 2019.

    Kinyanjui, who opposed the decision, said that Ksh1.5 million intended to be compensated was a lot depending on the circumstances, saying the amount should not exceed Ksh700,000.

    Mugi, on the other hand, supported the decision by confirming that the amount was equal to the medical expenses he had incurred in previous years.

    “The court has looked at the injuries sustained by the debtor. There is no doubt that he continued to break up with his wife. Two medical reports from Dr Kiamba and Dr Malik agree on the nature and extent of the injuries.

    “Obviously the respondent went through a very painful healing process. It appears that at one point the wound had sepsis and new treatments had to be made, ”court documents found.

    Chemitei, however, set aside the original decision and replaced it with a prize of total damage of Ksh 1million. The specific damage award still remained at Ksh28,250.
