Former rugby player Alex Olaba has been charged with conspiracy to commit murder.

Olaba, who appeared before Chief Justice Francis Andayi, denied the allegations and will remain in custody until Monday next week pending a decision on bail bail in a gang rape case.

On Monday, Andayi, who was expected to make a decision on bail conditions, filed a complaint because such a motion to deny bail to the accused was before another court.

“The same application is before another court and I think it is better to be placed in a decision as it will be a repeat of the decision on the same issue,” said Andayi.

Andayi added that prosecutors in the case had filed a motion before Judge Zainab Abdul challenging the release of the suspect on bail on the security of the witness.

He said it was best for the other court to deal with the matter as the objection was first filed.

It is alleged that on a different date between April 14 and April 22 in Nairobi County, along with others not in court, he conspired to kill the witness. Olaba faced another charge of conspiracy to win justice.

The prosecution led by Everline Onunga and Angela Fuchaka on Monday opposed the suspect’s release on bail.

They told the court that if Olaba was released on bail he would interfere with more government witnesses by killing the complainant.

“Your honor the accused in front of you is out to make sure the witness does not testify in court. He wants to achieve this by killing her, ”the prosecution said.

In another court case in Milimani prosecutors in the Olaba case where he was charged along with another former rugby player Frank Wanyama asked the court to cancel his bail of 300,000 shillings.

Olaba and Animal are in the case on a cash bond of Shs.300,000.

“Your owner we ask this court to cancel Olaba’s money bail” because he has committed an offense while out on bail. We also request that the witness be protected and that the case be heard on camera for security reasons, “prosecutors told Judge Zainab Abdul.

Judge Abdul’s decision on the application will be on May 10.

The suspect is being held at the Industrial Area prison.
