Olaba was arrested in Nairobi West on Thursday night on charges of attempted murder of a key witness in a rape case against him by Frank Wanyama.

According to police, he was planning to remove a key witness in the case in an effort to win justice.

He was arrested when he was confronted by a detective who killed a witness.

Police confiscated two calls from Olaba which are being investigated to determine if there were more players in the crime.

Reports indicate that Olaba had gone to another party to find ways to remove the witness.

Police were alerted and took immediate action by sending a detective who pretended to be the perpetrator of the message that led to Olaba’s arrest.

Following his arrest, Olaba, police said, claimed he had an evil spirit.

He is being held for felony criminal mischief for allegedly trying to kill and conspire to win justice.

Olaba and Wanyama are facing charges of rape in the Milimani court and are all out on Sh300,000 bail.

The two had been sentenced to 15 years in prison in August 2019 after being found guilty of gang rape.

The Supreme Court, however, quashed the sentence in June last year and ordered a re-hearing following an appeal filed by the defendants.

Judge Ngenye Macharia ordered the case to be re-heard in the lower court after the Supreme Court found that the available records did not indicate whether one of the witnesses in the case was sworn in or not.

The dancers were criticized by singer Wendy Kemunto for repeating sexually abusing her in their Seefar Apartment on February 10, 2018.

Kemunto made public the incident in April 2018, in an Instagram post column that sent the internet into a frenzy.

“I was slipping and out of consciousness it could have been because of the shock but I was helpless. I couldn’t fight the two men playing rugby. Obviously, they were strong so I let them do whatever they wanted to do all night.

“I could have reported the case to the police but I was in denial, shocked, in pain and exhausted. I did not want to report it either because of the profile of one of these rugby players,” he told police.

For his part, Wanyama said that he (Kemunto) was trying to deceive him.
