Emmy’s Brother Kosgey Meshack Sentenced to Five Years in Jail

The brother of gospel musician Emmy Kosgey has been sentenced to five years in prison for dangerous driving.

Meshack Kipkoech is said to have run over 6-year-old Birion Kinda, on December 25, 2017, along Nakuru-Mogotio Road.

The sentence is said to have resulted in two more accidents in the space of ten minutes on the same day.

The indictment stated that at 11.40am on Christmas day while driving along Nakuru-Mogotio Road in Rongai, Kipkoech drove recklessly and hit Kinda while crossing the road.

Kinda died four days later after sustaining serious injuries.

The deceased’s sister told the court that they had gone to pick up the shoes that their mother had bought for them. His brother, he testified, was the first to cross the road.

He begged the driver (Kipkoech) to help him take his younger brother to the hospital.

It was on the way to the hospital that Kipkoech hit a motorcyclist.

Eldama Senior Chief Magistrate Ravine John Tamar said Kipkoech had before his sentencing caused death by dangerous driving.

He was found guilty and ordered to pay the victim’s mother Sh954,000.

“Thus, noting that the defendant had preliminary records of death by accident, I sentence the defendant to five years’ imprisonment. In addition to and in accordance with Section 76 (1) (a) of the Traffic Act section VIII, I am revoking his driver’s license and declaring him eligible for another 10-year term, “the court said.

Kipkoech pleaded guilty to the charges and asked the court to tenderly, a prayer which the prosecution objected to establishing his previous convictions for such offenses.

In the 2008 case, Kipkoech was charged in Traffic No case 146 146/2008 with the charge of causing the death of a dangerous driver and causing the death of a police officer.

He was ordered to pay the deceased mother Ms Kotete Chebet, after beating and killing Mr Andrew Cheruiyot, along the Mogotio-Marigat road in Baringo.
