20 MCAs confirm arguments against President Tana River Speaker – KBC

Members of the Tana River County Assembly (MCAs) on Tuesday voted to confirm the motion to charge their speaker Michael Justin Nkaduda with negligence and misconduct.

The chairman of the seven-member Hirimani MCA temporary delegation committee Ismail Bodha Kodobo, which was formed last week to investigate allegations against the speaker presented their report.

Deputy Speaker Saddam Hussein, who chaired the session, announced that 20 MCAs had voted to remove the speaker from the 18-member level.

The Tana River County Assembly has 23 members, two of whom were absent.

The prosecution had three reasons; Negligence, misuse of office and misconduct.

The instigator of the indictment against Mohamed Buya appeared before the Ad Hoc committee and gave his opinion yesterday.

The tired speaker did not appear before the committee and was represented by his lawyers led by Ms Judith Thuku on Monday and said he was ill and lying in bed.

The Speaker’s lawyers sought a postponement which the committee had rejected as it would “interfere with their schedules”.

The report confirmed two reasons and ended the harassment of the office as it was not listed in section 11 of the County Government Act as one of the reasons for removing the speaker from office.

The report of the interim committee found that because of negligence against the speaker. As a result of his failure to convene meetings of the Public Service Board.

“The joint responsibility of providing medical insurance, vehicle maintenance and staff development could not be achieved,” read Kodobo.

The speaker was indicted for taking part in a boxing match with a minority leader, Hon. Abdi Garmaso after visiting his office to inquire about the state of medical insurance.

The ousted speaker has filed a case in Malindi Law Court against the Deputy Speaker and clerk of Tana River. The meeting has been postponed for one month.
